School Education- SSC Public Examinations Prohibiting the declaration and advertising of ranks for the SSC Public Examinations in any form at any level by School Managements to protect the interest of students and parents Orders Issued.

 2. From the Commissioner of School Education, A.P., and Director of Govt. Examinations, e-file Computer No.1727505 received on 19.05.2022.

ORDER:

In the G.O. 1st read above, orders were issued to follow the system of awarding of Marks to the students from the SSC Public Examinations, March 2020 on wards, duly dispensing with the Grading System.

The Commissioner of School Education, in the reference 2nd read above, has stated that the Director, Government Examinations received. several representations from the Parents and other stakeholders expressing concern over the publication of ranks and other misleading information by the educational institutions and tutorial institutions in both print media and electronic media for inducement of admissions, which is leading to unfair competition and undue pressure on the students..

The Commissioner of School Education stated that as per the Section 7A of the Andhra Pradesh Public Examinations (Prevention of Malpractices and Unfair Means) Act 1997, (Act 25 of 1997), "No person connected with an educational institution or a tutorial institution shall publish false or misleading information relating to the success of its students in a public examination". For the purpose of this section, an advertisement or other mode of publicity showing against a candidate any rank other than the rank assigned to him/her by the Convener of a public examination while declaring the results of such examination shall be construed as false or misleading information.

Further, as per the Section 8 of Act 25 of 1997, "Whoever contravenes or attempts or conspires to contravene or abets the contravention of the above provision shall be punishable with imprisonment for a term which shall not be less than three years but which may extend up to seven years with fine which shall not be less than rupees five thousand, but which may extend up to rupees one Lakh".

The Commissioner of School Education clarified that since the Director, Government Examinations is not publishing the ranks of the students, the educational institutions and tutorial institutions shall not declare/ announce the ranks of the students as per Section 7A of the said Act.

Government after careful examination of the matter, hereby order to prohibit the declaration and advertising of ranks for the SSC Public Examinations in any form at any level by School Managements to protect the interest of students and parents..

The Commissioner of School Education, A.P. and the Director of Government Examinations, A.P, shall take further necessary action accordingly, in the matter.

The Commissioner, Information & Public Relations, A.P., shall communicate the above orders by issuing necessary instructions to the print and electronic media, accordingly, in the matter.
